4. Client Responsibilities
As an OnCall business client, you agree to:
- Provide accurate information about your business and contact details
- Ensure you have the legal right to send SMS messages to your customers
- Comply with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA) and carrier guidelines
- Obtain proper consent from your customers prior to sending them marketing SMS messages
- Not use OnCall to send spam, illegal content, or messages that violate carrier policies
- Promptly honor opt-out requests (STOP replies) from your customers

Service fees are due as agreed upon at the time of enrollment. By providing payment information, you authorize us to charge your payment method for applicable fees. All fees are non-refundable except as required by law or as expressly stated in your service agreement. We reserve the right to suspend service for non-payment.

All content on this Site — including text, logos, designs, and software — is the property of OnCall and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission.
You retain ownership of your business data and customer information. By using our service, you grant OnCall a limited license to use that data solely to provide the service.
8. Disclaimer of Warranties
The Site and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated responses will always be accurate or appropriate. You are responsible for reviewing and overseeing automated communications sent on your behalf.
9. Limitation of Liability
To the fullest extent permitted by law, OnCall shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service, including but not limited to lost revenue, lost leads, or customer complaints arising from automated messages. Our total liability to you for any claim shall not exceed the fees paid to us in the 30 days prior to the claim.

You agree to indemnify and hold OnCall harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any applicable law or third-party rights, including TCPA compliance obligations.
11. Termination
Either party may terminate the service relationship at any time. We reserve the right to suspend or terminate your access to OnCall without notice if we believe you are violating these Terms or applicable law.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of San Diego County, California.
13. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the service after changes constitutes your acceptance of the updated Terms.
